2. The petitioner is apprehending his arrest in connection with Complaint Case No.178 of 2021, registered for the offence under Sections 33 and 42 of the Indian Forest Act, 1927 (Bihar Amendment Act, 1989), pending in the Court of the learned Chief Judicial Magistrate, Koderma.

Learned counsel appearing for the petitioner submits that the allegations are made that on Tata 709 mini truck, mica scrap was loaded. He further submits that the petitioner is neither the owner nor driver of the said truck. He then submits that only on suspicion, the name of the petitioner has come. He next submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 12 of this application. He also submits that the petitioner earns his livelihood by doing labour work.

Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of loading of mica scrap.
5. Considering that only on suspicion, the name of the petitioner has come and who has taken the name of the petitioner, that is not disclosed in the FIR and the petitioner has got no criminal antecedent, as disclosed in

paragraph 12 of this application and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Koderma in connection with Complaint Case No.178 of 2021, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
