The petitioner is apprehending his arrest in connection with Chainpur P.S. Case No.13 of 2008, corresponding to Spt. S.T. Case No.41 of 2025 (G.R.Case No.270 of 2008), for offence registered under section 302/34 IPC, pending in court of learned Additional Sessions Judge-II, Gumla. 3. Learned counsel for petitioner submits that the petitioner was in defense services and on the date of occurrence he was at place of his posting and has retired recently and thereafter he has come about pendency of this case. He also submits that two of the co-accused persons have faced trial and they have been acquitted by the learned court in S.T. No.255 of 2008 by the judgment dated 30.6.2016 and it has come that the death has occurred due to drowning in water. 2026:JHHC:2992 2 4. Learned State counsel opposes prayer and submits that the allegations are there. 5. Considering that on the date of occurrence the petitioner was at place of his posting and the co-accused persons who have faced trial, have been acquitted by the learned court in S.T. No.255 of 2008 by the judgment dated 30.6.2016 and it has come that the death has occurred due to drowning in water, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within four weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Additional Sessions Judge-II, Gumla, in connection with Chainpur P.S. Case No.13 of 2008, corresponding to Spt. S.T.
