JUSTICE RAVI CHIRANIA Order 14/07/2026 This Habeas Corpus Petition is filed seeking a direction to the respondents to produce petitioner’s husband namely Shri Bhikam. As per the missing person report dated 29.03.2023 lodged by the petitioner at Police Station Baseri, her husband had gone to buy vegetable on 27.03.2023 at 08:00 AM from his home, but did [2026:RJ-JP:26443-DB] (2 of 2) [HC-192/2026] not return. There is complete absence of any allegation of him being under illegal detention. As per the status report dated 13.07.2026 furnished by SHO Police Station Baseri, District Dholpur also, the husband of the petitioner is not found to be under any illegal detention. A Co-ordinate Bench of this Court has, vide order dated 24.09.2025 passed in the case of Smt. Babita vs. State of Rajasthan and others : D.B. Habeas Corpus Petition No. 290/2025, referring to and relying upon a catena of judgments of the Hon’ble Supreme Court and various High Courts, authoritatively held that the Writ of Habeas Corpus is maintainable only in case of illegal detention and not otherwise.
