By way of the instant petition, the petitioner seeks following prayers: “a) Issue a Writ of Mandamus or any other appropriate writ, order, or direction to the Respondents to immediately admit the Petitioner to Respondent No.2 hospital (AIIMS) for his medical treatment; b) Issue a Writ of Mandamus or any other appropriate writ, order, or direction to Respondent No.2 to forthwith constitute a medical board of competent doctors to examine the Petitioner and schedule and perform the necessary surgical intervention on an emergent and priority basis, without any further delay; c) Issue a direction to Respondent No.3 to make all necessary arrangements, including security and transport, to facilitate the Petitioner's admission, treatment, and surgery at Respondent No.2 hospital...” 2. No medical report has been received from the Senior Medical Officer Incharge, Jail Dispensary, Central Jail No. 1, Tihar, New Delhi. 3. The petitioner herein was taken to AIIMS Hospital on 11.03.2026, This is a digitally signed order. On 19.03.2026, he was asked to come on 23.03.2026, and on 23.03.2026, he was again asked to come on 20.04.2026. The report which has been earlier sent by the Senior Medical Officer Incharge, Jail Dispensary, Central Jail No. 1, Tihar, New Delhi reads as under: “As per available medical record inmate patient is a follow up case of right tubercular pleural effusion on Anti-Tubercular Treatment from CJ-01 Dispensary. Whereas for his all health issues he has been under regular follow-up with doctor on duty and Jail Visiting Specialists, he has also been referred to DDU Hospital/Lok Nayak Hospital/NITRD Hospital/RBTB Hospital & AIIMS Hospital and receiving proper treatment. On 12.01.2026 inmate patient was send to AIIMS Hospital Pulmonary Department for known complained of Right tubercular pleural effusion Enpyema ATT w.e.f 14.08.2025 where doctor diagnosed Right located Pyopneumothorax and advised thoracic Surgeon Opinion for Right located Pneuhothorax trapped lung, continue ATT for 3 months, incentive spirometry, breathing exercises, and medications accordingly. On 28.01.2026 inmate patient was again send to AIIMS Hospital Surgery Department wherein surgeon reviewed and examined inmate patient in view of right located pyopreumothorax trapped lung and advised to continue ATT, Pulmonary medicine follow up, HRCT Thorax, gastro medicine opinion for HCV pusitive status and management and review with report in surgery department. On 25.02.2026 inmate patient was again send to AIIMS Hospital Pulmonary Medicine Surgery Department with known history of PTB in 2025, symptom retained for 6 months, developed SOB, fever, cough, chest X-ray Right side pleural effusion revenue chest X-ray and advised referred to review AIIMS pulmology department for surgical intervention, to review AIIMS surgery department, chest physiotherapy, steam inhalation, continue ATT, blood investigations, PAC and review with report in lung clinic. On 11.03.2026 inmate patient was send to AIIMS Hospital lung cancer clinic with history of Right pyopreumothorax where doctor advised to review in surgery department. On same day inmate patient was reviewed in Pulmonary Medicine Surgery department with known case of Right pyopreumothorax S/P PTB on ATT from 14.06.2025 where doctor This is a digitally signed order. All blood investigations including X-Ray, ECG are done at CJ- 01 Dispensary. PAC date was provided by AIIMS Hospital 20.04.2026. As per instant court order dated 17.03.2026 for a letter is issued by this office to AIIMS Hospital for early date of PAC on 19.03.2026. On 20.03.2026 a letter from AIIMS Hospital regarding early date of PAC is received in which it is informed to send inmate patient on any working day (Monday-Friday) with original relevant original medical records for examination. Further inmate patient is scheduled for AIIMS Hospital on 23.03.2026....” 4. Considering the medical condition of the petitioner, the Medical Superintendent, AIIMS is directed to pre-pone the date for medical treatment of the petitioner herein. 5. The Jail Superintendent, Tihar, New Delhi is directed to ensure that the petitioner is taken to the hospital on 09.04.2026 for appropriate medical treatment. 6. In case, any emergent surgery is required, let a date be fixed by the concerned doctor, under intimation to this Court. 7. In view of above terms, the present petition stands disposed of. 8. Copy of this order be sent to the AIIMS Hospital for compliance, by the concerned Investigating Officer forthwith. 9. Copy of this order be given dasti to the I.O. for compliance. 10.
