Learned advocate appearing for the petitioner submits that the petitioner is in custody for 107 days, the investigation of the case is over and so far as the allegation against the present petitioner is concerned, the same is restricted to omnibus allegation of demand of dowry and consequent to which his wife committed suicide. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account the statement of the witnesses which not only implicate the present petitioner, but also other inmates of the matrimonial home. However, it is an admitted fact that after three years of marriage, the deceased committed suicide by hanging. Prosecution has relied upon 16 witnesses in order to prove its case which would consume some time for the trial court to take the trial
2 to its logical conclusion. Considering the factual matrix of the case and the future course of time which may be consumed, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Jasim @ Jashim Mondal shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Kalyani. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Court and shall not leave the jurisdiction of the district of Nadia without prior permission of the learned Court. The application for bail, being CRM (M) 785 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
