ORAL JUDGMENT Appellant's counsel files a memo for withdrawal of appeal, in which it is stated as under:
" The appellant submits as follows:-
1. At the first instance challenging the Judgment and
Order dated 19/09/2025 in 65/2024 the appellant had filed Criminal Revision Petition No.23/2026. Noting that the said revision petition was not maintainable in view of fact that the challenge was to an order of acquittal in case of a private complaint, upon a memo filed by the appellant, this Hon'ble Court permitted conversion of the said Criminal Revision Petition Into Criminal Appeal. Hence criminal revision petition number was renumbered as Crl.A. No. 136/2026.
2. Noting the number of corrections that had to be made in order to convert the said revision petition into

criminal appeal, the appellant has now filed a separate Criminal Appeal which is numbered Crl.A.No.151/2026.
3. In that view of the matter, it is just and necessary that this Hon'ble Court be pleased to permit the Appellant to withdraw the above Appeal, with liberty to prosecute Criminal Appeal No.151/2026.
Wherefore, it is most humbly prayed that this Hon'ble Court may please to permit the appellant to withdraw the above appeal with liberty to prosecute criminal appeal No 151/2026, in the interest of justice and equity".
2. In view of the memo, the appellant is permitted to withdraw this case with liberty to prosecute the Crl.A.No.151/2026.
3. Accordingly, this appeal is disposed of as withdrawn.
