By means of the present Criminal Writ Petition, the petitioners have approached this Court seeking the following relief: “i. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent nos. 1 and 2 to provide adequate police protection to the petitioners, as they are seriously apprehending threat to their life and liberty at the hands of respondent no. 3 and other family members.” 3. Learned counsel for the petitioners submits that both the petitioners are major and solemnized their marriage on 19.08.2026. Learned counsel further submits that the petitioners apprehend threat to their life and personal liberty at the hands of respondent no. 3. Accordingly, the petitioners seek appropriate directions for protection of their life and personal liberty. 4. Having heard learned counsel for the parties and upon perusal of the material available on record, this Court is prima facie satisfied that the petitioners have made out a case for consideration of their grievance regarding protection of their life and personal liberty guaranteed under Article 21 of the Constitution of India. The law laid down by the Hon’ble Supreme Court in Lata Singh v. State of U.P. and Another also recognizes that two major individuals are entitled to choose their partner and cannot be UKHC010150492026 2026:UHC:7574 subjected to threats or harassment on account of such choice. 5. Accordingly, the Station House Officer, Police Station Kotwali Civil Lines, Roorkee, District Haridwar, is directed to assess the threat perception, if any, to the life and personal liberty of the petitioners. In the event any genuine threat is found to exist, the concerned police authorities shall provide adequate protection to the petitioners strictly in accordance with law. The Station House Officer shall also summon respondent no. 3, as well as any other person found to be interfering with or threatening the petitioners, and counsel them to maintain peace and refrain from taking the law into their own hands. 6. With the aforesaid directions, the present Criminal Writ Petition stands disposed of.
