Considering the disputes having arisen between the parties and in view of Clause 25.4 of the Agreement which mentions of the disputes being resolved through a sole arbitrator and due notice having been served on the respondents on 06.03.2023, the [2026:RJ-JP:24904] (2 of 3) [ARBAP-80/2023] application has been moved for seeking appointment of an arbitrator to resolve the disputes. 2. Clause 25.4 of the Agreement reads as under: "25.4 Any dispute or difference whatsoever arising between the parties to this Contract out of or relating to the construction, meaning, scope, operation or effect of this Contract or the validity of the breach thereof shall be referred to a sole Arbitrator to be appointed by mutual consent of both the parties herein. If the parties cannot agree on the appointment of the Arbitrator within a period of one month from the notification by one party to the other of existence of such dispute, then the Arbitrator shall be appointed by the legally authorized competent authority, Rajasthan, India. The provisions of the Arbitration and Conciliation Act, 1996 will be applicable and the award made there under shall be final and binding upon the parties hereto, subject to legal remedies available under the law. Such differences shall be deemed to be a submission to arbitration under the Indian Arbitration and Conciliation Act, 1996, or of any modifications, Rules or re- enactments thereof. The Arbitration proceedings will be held at Jaipur, India. Any legal dispute will come under the sole jurisdicition of Jaipur, India. 3. Reply has also been filed on behalf of the respondent No.2 which reflects that dispute has arisen between the parties. 4. In view of above, all the preliminary objections raised on behalf of respondent-Rajasthan Urban Drinking Water Sewerage and Infrastructure Corporation Limited is available to be taken up before the sole arbitrator. 5. This Court with the consent of learned counsel for the parties, deems it appropriate to appoint Hon'ble Mr. Justice G.K. Vyas, (Former Judge Rajasthan High Court), R/o Sector-17E, House No.317, Chopasani Housing Road, Jodhpur, to act as the Sole Arbitrator to decide all issues without prejudice to the rights and contentions raised in the present application. The arbitration fees shall be determined in accordance with the Fourth Schedule of the Act of 1996, as amended. The fee of the Arbitrator will be equally borne by both the parties. 7.
