Pursuant to the order passed by this Court on 30th April 2026, the subject property has been inspected by the respondent no.1/MCD and a status report has been filed by MCD. 2. In the aforesaid status report, it is stated that the subject property comprises the basement, ground floor to fourth floor and part fifth floor. The subject property is old and as per the record, no sanction plan has been obtained. The subject property has been booked for unauthorised This is a digitally signed order. It is further stated that misuse activity at the fourth floor (part) and terrace of the fourth floor in the shape of temporary structure/makeshift kitchen has been noticed, for which a show cause notice dated 20th May 2026 has been issued to the owners/occupiers of the subject property. 3. Counsel for the private respondent no.2 submits that a personal hearing be granted to the said respondent by MCD. He further submits that the respondent no.2 has stopped running the kitchen in the subject property. 4. In view of the aforesaid, the petition is disposed of in terms of the following directions: i. The private respondent no.2 is at liberty to reply to the aforesaid show cause notices. The reply shall be filed within two (2) weeks from today. ii. Based on the aforesaid reply, the respondent no.1/MCD shall grant a personal hearing to the private respondent no.2. iii. Based on the aforesaid, the respondent/MCD shall take appropriate action in accordance with law. 5. In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law. 6.
