The petitioner has filed this writ petition praying for the following reliefs: 10.1 That, this Hon’ble Court may kindly be pleased to call for the entire record concerning the decision taken by the respondents concerning payment of pension to the petitioner from the respondents for its kind perusal. 10.2 That, this Hon’ble Court may kindly be pleased to pass an appropriate order/writ directing the respondent authorities to pay pension to the petitioner forthwith. 10.3 That, this Hon’ble Court may kindly be pleased to pass an appropriate order/writ directing the respondent authorities to release the gratuity, GIS, provident fund and leave encashment to the petitioner with payment of penal interest @ 18% per annum payable to the petitioner from the date it fell due till the date of 3 actual payment. 10.4 Any other relief, which this Hon’ble Court, may deem fit and proper, in the facts and circumstances of the case. 2. Counsel for the petitioner submits that petitioner has retired from post of Principal on 31.01.2026 however the petitioner has not bee paid the pension amount. He submits that when enquiry is made by the petitioner he was informed that one departmental enquiry is pending against him and therefore the pension amount has not been released in his favour. It is the contention of counsel for the petitioner that petitioner thereafter submitted a representation before the respondent no. 6 for grant of anticipatory pension pending enquiry against him which is not considered. Petitioner being a retired employee facing the financial hardship to take decision on the representation submitted by the petitioner keeping in mind the provisions of Chhattisgarh Civil Services (Pension) Rules, 1976. 3. Counsel for the State submits that in view of the limited prayer of the counsel for the petitioner, he is having no objection. 4. I have heard learned counsel for the respective parties. 5. On due consideration of the submission of the counsel for the respective parties, in particular that petitioner has already submitted a representation on 24.02.2026 before respondent no. 6 as well as representation dated 27.02.2026 before respondent no. 1, therefore respondent no. 1 and 6 are directed to consider 4 and take decision on the representation submitted by the petitioner in accordance with law expeditiously preferably within a period of 4 weeks from the date of receipt of copy of this order.
