This is the First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 956/2025 registered at Police Station – City Kotwali, District – Sarguja (C.G.) for the offence punishable under Section 109(1), 311, 309(6) and 3(5) of the BNS. 2. Case of the prosecution, in brief, is that the complainant on 29.12.2025 lodged a report that on 28.12.2025 at 09:54 pm, he received a call from his maternal uncle the injured that someone had hit him with a stick on the colony road, come quickly. Then he went straight to JK Hospital Ganga where he saw that the injured was lying unconscious in the emergency room. After treatment, the injured regained consciousness and told the complainant about the RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 incident that at around 09:30 P.M., he had left for home on his Scooty Maestro carrying around Rs. 20,00,000/- in cash and three mobile phones with numbers 9074843131, 91669256789, 7489457547 in a big printed Bag. On the way, near the house, a person was hiding behind a brick mound that had fallen down, from where someone suddenly attacked the injured, Anil Agarwal, with a big bamboo stick with the intention of killing him and for which he fell unconscious. When he regained consciousness some time later, he saw that his head and face were bleeding profusely. The person who had attacked him had fled with the help of someone, who had looted the bag containing the money. The complainant and one Aman Agarwal then reviewed the CCTV footage from the surrounding area and discovered that a man on a Pulsar motorcycle was seen carrying the same bag containing the money after the incident. These men had allegedly looted the bag with the intent to kill. Anil Agarwal's employee, Sidhan Ram Rajwade, stated that the man with the Pulsar motorcycle and his companion were conducting a recce of the office of shop of injured, located on Ram Sahar Road, at around 9:20 pm. The robber was identified as Deepak Das, a former employee of shop of injured. 3. Learned counsel appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is submitted that the charge-sheet has been filed in this case. It is submitted that the applicant is in jail since 29.12.2025, and the conclusion of the trial shall take quite long time. Therefore, he prays for grant of bail. 3 4. On the other hand, learned State counsel, opposes the bail application and submits that the applicant is said to have assaulted the injured with big bamboo stick on his head due to which he has suffered injuries on head, and thereafter, the applicant and the co- accused looted the money of the injured to the tune of Rs. 20 Lakhs and fled away, and out of the said amount, Rs. 1 Lac has been recovered each from the possession of the accused persons. As such, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and also the fact that the applicant is said to have assaulted the injured with big bamboo stick on his head due to which he has suffered injuries on head, and thereafter, the applicant and the co- accused looted the money of the injured to the tune of Rs. 20 Lakhs and fled away, and out of the said amount, Rs. 1 Lac has been recovered each from the possession of the accused persons, thus, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, this bail application of applicant – Deepak Das involved in Crime No. 956/2025 registered at Police Station – City Kotwali, District – Sarguja (C.G.) for the offence punishable under Section 109(1), 311, 309(6) and 3(5) of the BNS, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed with the trial and conclude the same, expeditiously. 4 9.
