Standing Counsel, for the respondent no. 3, 4 and 5. (2) Petitioner is serving as Major in 130 Infantry Battalion, Territorial Army, Eco Kumaon at Pithoragarh since 13.12.2023. He was transferred to 120 Infantry Battalion, Territorial Army, Bihar, vide order dated 10.10.2024. Petitioner challenged the said order mainly on the ground that he is transferred before completion of normal duration of posting i.e. three years at Pithoragarh. Coordinate Bench passed interim order on 21.10.2024, staying the effect and operation of the transfer order till next date of listing. On the strength of that interim order, petitioner is continuing at Pithoragarh. (3) Learned Counsel for the respondents submits that the ground taken by petitioner for challenging his transfer is factually not correct; as per the policy, applicable to officers of Territorial Army, normal period of posting at one place is two years and not three years, as contended by UKHC010166542024 2026:UHC:7226-DB the petitioner. (4) Major Karan Singh Sandhu, Legal Officer, Territorial Army Directorate, Army Headquarters, New Delhi is physically present in Court. He made a statement that the competent authority will recall the transfer order, impugned in this writ petition, and pass fresh order of posting in respect of petitioner within four weeks. He further assures that permanent status, which petitioner is having right now, will not be disturbed because of his posting. He further assures that the competent authority will try to accommodate the petitioner at some peace or modified field station. (5) Law is well settled that judicial interference with order of transfer passed in respect of government servants has to be minimal and that is more so in case of army officers. This Court do not find any reason to interfere in the matter, especially when petitioner has served at one place for more than two and half years.
