Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in proceeding with the land acquisition and disbursement of compensation in respect of the suit schedule properties, which are the subject matter of O.S. No. 12 of 2025 pending before the Honble II Additional District Judge, Hindupur, without considering the petitioner's claim and representation dated 22.07.2026, as illegal and arbitrary, and consequently direct the respondents to keep the compensation amount pertaining to the suit schedule properties in Survey Nos.
133-4A, 132-4, 132-3, 132-2, 132-1A, 133- 1, 133-4 of Brahmanapalli Village and Survey No. 116-1 of Kappala Banda and Beedupalli Villages, Puttaparthi Mandal, in safe custody of the Land Acquisition Officer/Revenue Divisional Officer until disposal of the partition suit in O.S. No. 12 of 2025 IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to keep the compensation amount payable in respect of the schedule properties in O.S. ORDER
The above writ petition is filed to declare the action of 3rd respondent in attempting to disburse the compensation amount, despite pendency of suit
O.S.No.12 of 2025 on the file of II Additional District Judge, Hindupur, without considering the petitioner’s claim and representation dated 22.07.2026 in respect of suit schedule properties in Survey Nos.133-4A, 132-4, 132-3, 132- 2, 132-1A, 133-1, 133-4 of Brahmanapalli village, and S.No.116-1 of Kappala Banda and Beedupalli village, Puttaparthi Mandal, as illegal and arbitrary. 2. Sri Chandra Sekhar, learned Assistant Government Pleader for Revenue for the respondents submitted the written instructions of the 4th respondent-Tahsildar, wherein it was stated thus:
“As per the RSR of Brahmanapalli village of Puttaparthi Mandal, the lands in S.No.133-4A, extent Ac.0.10; S.No.132-4, extent Ac.2.69; S.No.132-3, extent Ac.0.98; S.No.132-2, extent Ac.1.08; S.No.131-1A, extent Ac.1.46; S.No.133-1, extent Ac.1.02; and S.No.133-4, extent Ac.2.69 of Brahmanapalli village were assigned to the petitioner’s father- in-law and grandmother. After the demise of the assignees, the lands were transferred to their legal heirs. As per the present records, Smt. Muthyalamma, W/o Narasimhulu, is the pattadar. There is a dispute among the petitioner and her family members in respect of the said lands. The petitioner, Smt. B.N. Varalakshmi, has filed a suit vide O.S.No.03/2024 before the Court of the Senior Civil Judge, Penukonda, and the said case is still pending.
At present, the above mentioned lands have been notified for land acquisition by APIIC for establishment of industries. Notices have also been issued to the concerned parties. However, compensation has not been paid to anyone. As per the final orders of the Court of the Senior Civil Judge, Penukonda, in O.S.No.03/2024, compensation may be paid as per the orders of the Court.”
3. Given the instructions of the 4th respondent, without going into merits of the matter, the Writ Petition is disposed of at the admission stage with the consent of learned counsel on either side, directing the respondents to
disburse the compensation amount in terms of the decree in O.S.No.3 of 2024 on the file of the Senior Civil Judge, Penukonda. No order as to costs. As a sequel, all the pending miscellaneous applications shall stand closed. ___________________________ JUSTICE SUBBA REDDY SATTI PVD
