The petitioner is apprehending her arrest in connection with Bero P.S. Case No. 97 of 2023, registered for the offence under Sections 406, 420 and 34 of the Indian Penal Code, pending in the court of learned Judicial Magistrate, 1st Class, Ranchi. 3. Learned counsel appearing for the petitioner submits that the petitioner is a lady and at the relevant point out of time, she was working as Jal Sahiya in Village-Tero, P.S. Bero, District Ranchi. He next submits that the petitioner has already replied to the notice under Section 41-A of Cr.P.C. He further submits that the allegations are made that Rs. 39000/- has been withdrawn from the account of Jal avam Swachhata Samiti, however, when it has been pointed out the petitioner has already returned Rs. 20,000/- on 19.06.2023 and Rs. 19,000/- on 14.07.2023 and that has come in para-85 of the case diary. He also submits that in this regard, the disclosure has also been made in para-9 of the petition. 4. Learned A.P.P. appearing for the State has opposed the [2026:JHHC:11501] -2- prayer and submits that the allegation is there of illegally withdrawing of Rs. 39,000/- from the account of Jal avam Swachhata Samiti. 5. In para-9 of the petition, it has been disclosed that petitioner has already returned Rs. 20,000/- on 19.06.2023 and Rs. 19,000/- on 14.07.2023 and that has come in para-85 of the case diary and further the petitioner has already replied to the notice issued under Section 41-A of Cr.P.C., in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
