Heard Mr. A. Ahmed, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State.
2. This subsequent bail petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner, namely, Jahirul Islam, has prayed for granting pre-arrest bail, apprehending arrest in
Page No.# 2/2 connection with Jagiroad P.S. Case No. 267/2025 under Section 318(4)/316(3)/314 of BNS, 2023.

The learned counsel for the petitioner reiterates his contention that the petitioner herein is a professional driver who might have driving the said JCB on hire upon payment of Rs.2,000/- and further submits in this regard that he is not involved in commission of any offence with regard to the said JCB.
4. On the other hand, learned Additional Public Prosecutor submits that investigation has found some incriminating materials against the petitioner. However, he has fairly submitted that pursuant to grant of interim bail, the petitioner has appeared before the I/O, whereupon he was examined again.
5. In the given facts and circumstance, despite the implications projected by the prosecution, I do not deem it fit to cancel the interim bail granted to the petitioner.
6. Accordingly, the interim protection vide dated 26.05.2026 is hereby made absolute subject to the conditions – that the petitioner shall co-operate with remaining investigation as and when required; that the petitioner shall not commit any illegal activities or offences; and that the petitioner shall not hamper or tamper with evidence.
7. Violation or breach of condition(s) shall entail cancellation of the bail.
8. The petition stands disposed of accordingly.
