Learned advocate appearing for the petitioner submits that there were alleged recoveries of low quality of FICN to the tune of Rs.7,000/- and the petitioner is in custody for 192 days. Charge- sheet has already been submitted, as such, the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail. I have taken into account the quantum of seizure which is 14 FICNs, there are no criminal antecedents of the present petitioner and the fact that charge-sheet has already been submitted before the jurisdictional court. Guided by the aforesaid, I am inclined to release the petitioner on bail. As such, the prayer for 2 bail of the petitioner is allowed. The petitioner, namely, Abdul Rahaman shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Chanchal, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned court and shall not leave the district of Malda without prior permission of the learned court. Accordingly, CRM(M) 735 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
