Applicants - Mitranand Nautiyal and Prem Bala seek anticipatory bail in connection with FIR/Case Crime No. 13 of 2026, under Sections 318(4), 351(2) and 352 of BNS, registered at Police Station Raiwala, District Dehradun. 4. Heard learned counsel for the parties and perused the record. 5. Learned counsel for the applicants submits that they have returned back the alleged amount of Rs. 19 Lakhs, which was wrongly deposited in their account by the complainant. 6. This fact has also been verified by learned State Counsel as per their instructions. 7. Having considered the submission of learned counsel for the parties and also considering the fact that the alleged amount has been returned back by the applicants to the complainant, this Court is of the view that this is a case, in which the applicants should be granted anticipatory bail. The instant anticipatory bail application deserves to be allowed. 8. Accordingly, the anticipatory bail application is allowed. 9. In the eventuality of arrest, the applicants shall be enlarged on bail on their furnishing a personal bond and two reliable sureties, each in the like amount, to the satisfaction of the Investigating Officer/court concerned. In addition to it, the applicants shall also comply with the following conditions:- (i) The applicant shall co-operate with the investigation. (ii) The applicant shall not approach any witness/victim in any manner, whatsoever. (iii) The applicant shall not leave the country without prior permission of the concerned court. 10. It is made clear that if the applicants misuse or violate any of the conditions, imposed upon them, the prosecution agency will be free to move the Court for cancellation of the anticipatory bail.
