BEFORE HONOURABLE MR. JUSTICE ANJAN MONI KALITA ORDER Date : 21-07-2026 Heard Mr. J N Suwai, the learned counsel for the accused/applicant. Also heard Mr. D Gogoi, the learned Special PP for Forest Department, Wild Life Department.
2. This is an application u/s 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 praying for granting pre-arrest bail to the accused/applicant in
Page No.# 2/2 connection with Kulsi Forest Range Case No : Offence No. K/05 of 2026-27 u/s 4/24/25/60 of Assam Forest Regulation Act, 1891.
3. An Offence Report on 12.05.2026 has been lodged by one Rajib Roy at forest office Kulsi alleging that four persons are involved in cutting down trees. In terms of the Offence Report the Kulsi Forest Case No. Offence No. K/05 of 2026-27 in the aforementioned sections was registered.
4. The learned counsel appearing for the accused/applicant submits that forest personnel have visited him and therefore he has apprehension of arrest and accordingly he filed anticipatory bail application in this Court.
5. Mr. D. Gogoi, the learned Special PP submits that the accused/applicant may not be required in the connected Offence Report.
6. Taking into account the submissions made by learned counsel for the parties and on perusal of the case record, this Court is of the opinion that at this stage the accused/applicant may be granted the privilege of anticipatory bail.
7. Accordingly, it is directed that in the event of arrest of the accused/applicant, namely, Shri Briksha Rabha in connection with Forest Range Case No : Offence No. K/05 of 2026-27, he shall be released on furnishing of a bail bond of Rs. 20,000/- (Twenty thousand) only with a surety of like nature to the satisfaction of the learned Arresting Authority under the condition that the accused/applicant shall cooperate with the investigation, if so required.
8. In terms of the aforesaid direction, the instant AB application is disposed of as allowed. JUDGE Comparing Assistant
