Learned advocate appearing for the petitioner submits that the subject matter of recovery relates to recovery of 121 kgs of ganja from the joint possession of the petitioner and others. Learned advocate for the petitioner emphasizes that only 16.99 kgs of ganja were recovered from the possession of the petitioner, as such, he may be granted bail. Learned advocate for the State opposes the prayer for bail and submits that there has been no change of circumstances and witness action is about to commence in the present case. Having regard to the stage of the case, I am not inclined to release the petitioner on bail. Petitioner would be at liberty to renew his prayer for bail after the evidence of seizure list witnesses are over.
2 As such, the prayer for bail of the petitioner at this stage in CRM (NDPS) No. 665 of 2026 is rejected. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
