2. The petitioner is apprehending his arrest in connection with Domchach P.S. Case No. 12/2025, registered under sections 190, 191(2), 49, 115(2), 127(2), 121(1) (2), 125(B), 109(1), 132, 352, 351(2), 61 (1) (a) of BNS, 2023 (corresponding sections 149, 147, 109, 323, 341, 342, 332, 333, 338, 307, 353, 504, 506, 120(A) of I.P.C) pending in the Court of learned Chief Judicial Magistrate, Koderma.

Learned counsel for the petitioner submits that earlier the petitioner has moved in A.B.A. No. 3431 of 2025 which was dismissed as withdrawn by order dated 30.06.2025 and in changed circumstances second anticipatory bail application has been filed when subsequently by order dated 14.08.2025 six of the co-accused persons have been granted anticipatory bail in A.B.A. No. 4412 of 2025 and prior to that two of the co-accused persons have been granted anticipatory bail in A.B.A. No.2293 of 2025. He next submits that petitioner happens to be bank employee and on the alleged date of occurrence i.e. 11.12.2025 the petitioner was on duty in Bank of Maharashtra, Deoghar Branch, Deoghar whereas occurrence took place in Giridih and to buttress this argument he refers to certificate dated 17.07.2025 issued by Branch Manager contained in annexure-3 to this

petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that earlier anticipatory bail application of the petitioner has been dismissed as withdrawn.

Considering that subsequently by different orders the co- accused persons have been granted anticipatory bail in A.B.A. Nos. 4412 of 2025, 5202 of 2025, 5377 of 2025, 7372 of 2025 and in view of that second anticipatory bail application can be entertained. Further annexure-3 is document issued by Branch Manager which suggests that on the alleged date of occurrence the petitioner was discharging his duty at Deoghar whereas occurrence took place in Giridih, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Koderma, in connection with Domchach P.S. Case No. 12/2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
