The petitioners have alleged that the private respondents have encroached upon a portion of the property of the petitioners and are also taking steps to encroach upon the land belonging to the Public Works Department. The petitioners claim to have submitted a representation before various authorities through the learned advocate’s letter dated March 16, 2026. The learned advocate appearing for the petitioners submits that in spite of receipt of such representation, no steps have been taken by the respondent authorities to remove the encroachment from the PWD land. Heard the learned advocates for the State and the private respondents. 2 After going though the representation made by the petitioners through their learned advocate’s letter dated March 16, 2026, it appears to this Court that the petitioners have alleged encroachment upon their raiyati property. The issue relating to encroachment of a private property by another private individual cannot be the subject matter of a writ petition. Faced with such situation, the learned advocate for the petitioners prays for a liberty to submit a comprehensive representation before the appropriate authority. WPA 7830 of 2026 stands disposed of by granting liberty to the petitioners to submit a comprehensive representation before the concerned authorities insofar as the allegations of the petitioners relates to encroachment upon the PWD land is concerned. If such a representation is submitted, the concerned authority shall consider and dispose of the same in accordance with law as expeditiously as possible. There will be no order as to costs.
