Learned advocate for the petitioner prays for cancellation of bail granted to the o.p. no.2 on 29.10.2024. According to the petitioner, the o.p. no.2 [Saikat Halder @ Daku] is the person who fired at the injured/victim. Inspite of the same, the learned court was pleased to grant him bail. Learned advocate for the State is present and supports the contentions of the present petitioner. Having considered that the bail was granted on 29.10.2024 which may not be to the liking of this court; the reasons which have been assigned; the time period which has lapsed in the meantime and the fact there are no materials appearing before this court which suggests that the petitioner has misused the liberty while on bail, I am not inclined to interfere with the order of bail being granted at this belated stage. However, the offence complained of shows aggression and involvement of deadly weapons like fire arms.
2 Having considered the same, it is directed that the petitioner would stay outside the jurisdiction of Kotwali Police Station, Krishnagar till the evidence of the vulnerable witnesses is over before the learned trial court. With the aforesaid observations, CRM (DB) 4239 of 2024 is disposed of. Learned advocates for the petitioner, State as well as the o.p. no.2 will communicate this order to the learned trial court and/or the Court in seisin of the case.
