Rakib (Allowed) CRM (NDPS) 668 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kirnahar Police Station case no. 110 of 2025 dated 17.10.2025 under Sections 20(b)(C) of the NDPS Act. And In the matter of : Fulchand Sk. ……Petitioner. Mr. Navanil De Mr. Srinjan Ghosh .....for the Petitioner. Mr. Bibaswan Bhattacharya Mr. Dipankar Paramanick ……for the State. Learned advocate appearing for the petitioner submits that the subject matter of recovery in the present case is 21.865 kgs of ganja and the petitioner is in custody for six months. Prosecution has already submitted charge-sheet and has relied upon 11 witnesses in order to prove its case. Learned advocate for the State opposes the prayer for bail. Having considered the quantum of seizure and the period of detention of the present petitioner as also the fact that the prosecution will take some time to conclude the evidence of the 11 witnesses which has been cited in the charge-sheet, I am of the view that further incarceration of the petitioner is unwarranted. As such, prayer for bail of the petitioner is allowed. Accordingly, petitioner namely, Fulchand Sk shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees 2 Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court (NDPS Act) cum learned Additional District and Sessions Judge, 1st Court, Suri, Birbhum. If on bail, the petitioner shall be physically present on each and every date fixed by the learned Special Court and shall not leave the jurisdiction of District of Birbhum without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) No. 668 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
