1. Affidavit of service filed on behalf of the petitioner is taken on record. 2. By the present writ petition, the petitioner seeks direction upon the respondent authorities to grant ‘A’ category scale of pay to the petitioner from the date of publication of results of B. Ed degree. 3. The petitioner contends that the petitioner joined as an Assistant Teacher in 68, Sitalnagar Primary School within the jurisdiction of Murshidabad District Primary School Council on 1st July, 2010. The petitioner obtained the B.Ed. degree on 30th July, 2010. Six months Bridge Course has also been completed by the petitioner in the year 2015. On 19th July, 2025 the petitioner made a representation before the concerned authority for grant of ‘A’ category scale of pay. 2 However, the same is pending consideration. Hence, this writ petition. 4. Mr. Santanu Maji, learned Advocate appearing on behalf of the petitioner submits the matter be relegated to the appropriate authority for due consideration. In support of his contention, he relies on the following decisions: (i) Waliur Rahaman & Ors. versus The State of West Bengal & Ors. (In Re: MAT 1038 of 2024); (ii) Khokan Das versus The State of West Bengal & Ors. (In Re: WPA 13023 of 2025); (iii) Mahammad Enamul Haque versus The State of West Bengal & Ors. (In Re: WPA 29672 of 2024) ; (iv) Rezaul Saikh & Ors. versus The State of West Bengal & Ors. (In Re: WPA 22526 of 2024). (v) Tuhin Hossain versus The State of West Bengal & Ors. (In Re: WPA 19110 of 2025). 5. Md. Sarwar Jahan, learned Advocate for the District Primary School Coucnil, Murshidabad as well as Mr. Sankar Halder, learned Advocate appearing on behalf of the State concedes such submission. 6.
In view of the above, the Commissioner of School Education, Government of West Bengal, respondent no.2, is directed to consider the representation of the petitioner dated 19th July, 2025 and dispose of the same by passing a reasoned order, in accordance with law, upon notice to the petitioner, within a period of
3 twelve weeks from the date of communication of the
order.
7. The reasoned order is to be communicated to the petitioner within one week from the date of passing of such order.
8. Learned advocate for the petitioner is directed to communicate this
order to respondent no.2, Commissioner of School Education, Government of West Bengal, for necessary compliance.
9. With the above direction, the writ petition being WPA 17492 of 2025 stands disposed of.
10. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.
11. Interim order, if any, stands vacated.
12. All connected applications, if any, stand disposed of.
13. There shall be no order as to costs.
14. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.
15. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
