Heard the parties. 2. The petitioner is challenging Annexure-3 by which the services of the petitioner has been terminated. 3. The petitioner was a Block Animal Husbandry Officer. He got convicted in Sessions Trial No.899 of 2013, arising out of G.R. Case No.6548/2012, corresponding to Bariatu P.S. Case No.275/2012. This conviction is under Section 306 of IPC. Since, the petitioner has been convicted, he has been dismissed from service. I find no illegality in the order of dismissal. 4. However, since the appeal is pending, it will be open to the petitioner to approach the authority, if the appeal ultimately is allowed in favour of the petitioner.
