Deuri, learned counsel for the petitioner. Also heard Mr. N. Kohli, learned Sr. counsel assisted by Mr. S.P. Das, Mr. A. Roy and Ms. N. Menon, learned counsel appearing for the respondents. Mr. Deuri, after attempting to argue the matter at some length, in view of a query raised by this Court, has submitted that he be permitted to withdraw the present writ petition with liberty to raise contentions before the Enquiry Officer during recording of his statement, that the allegations/ charges as leveled/ framed are not attracted to him. The said prayer is not objected to by Mr. N. Kohli, learned Sr. counsel appearing for the respondents. In view of the submission of the learned counsel for the petitioner, the present writ petition stands dismissed on withdrawal, with liberty to the petitioner to raise contentions during his deposition in the enquiry that the charges levelled against him in the Departmental Proceeding so instituted, are not attracted to him.
