Verma, A.P.P. ------ 09/ 04.05.2026 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner is apprehending his arrest in connection with Mango (Olidih O.P.) P.S. Case No. 75 of 2025, registered for the offence under Sections 85, 64(1), 67, 79, 115(2), 117(2), 126(2), 316(2),318(4), 351(2), 352,351(3),61(2),64(5) of Bharatiya Nyaya Sanhita, 2023, Sections 4 and 6 of POCSO Act and Sections 3(x) and 3(xi) of SC/ST Act, pending in the court of learned Special Judge Exclusive (POCSO) Court, Jamshedpur. 3. Learned counsel appearing for the petitioner submits that false allegations are made against the petitioner and petitioner is nothing to do with the said allegation. He next submits that the petitioner happened to be the elder brother of Rahul Mahto. On these grounds, he submits that anticipatory bail may Kindly be provided to the petitioner. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that allegations are also there against the petitioner and his mother of torturing the informant and forcing her to leave the house along with her minor child. On these grounds, he submits that anticipatory bail may kindly be rejected. [ 2026:JHHC:13123] -2- 5. Looking into the contents of the FIR, it transpires that the informant is a minor and she has been tortured in many ways and the same is disclosed in the FIR. There is no doubt that the relationship has been established by the brother of this petitioner, however, allegations are also made against this petitioner and his mother of torturing the girl at several point out of time and they were also abused her in the filthy language. 6. In the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, his prayer for anticipatory bail is rejected.
