By means of the present application, the applicant seeks grant of anticipatory bail in connection with FIR No. 461 of 2023, registered at Police Station Bazpur, District Udham Singh Nagar, for the offences punishable under Sections 323, 376 and 506 of the Indian Penal Code. 3. The Coordinate Bench of this Court, vide order dated 21.11.2023, granted interim anticipatory bail to the applicant. In compliance with the conditions stipulated therein, the applicant has duly cooperated with the investigation as and when called upon by the Investigating Officer. 4. Learned counsel for the applicant submits that the applicant has also preferred an application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, being C-528 Application No. 147 of 2026, in which the Coordinate Bench of this Court, vide order dated 03.02.2026, stayed the entire proceedings. 5. Learned counsel for the applicant further submits that, pursuant to the interim protection granted by this Court, the applicant has cooperated throughout UKHC010185722023 2026:UHC:7321 the investigation and has not misused the liberty so granted to him. It is further submitted that the investigation has culminated in the submission of the charge-sheet and, therefore, no custodial interrogation of the applicant is required at this stage. 6. Having heard learned counsel for the parties and upon perusal of the material available on record, this Court finds that the applicant has remained protected by virtue of the interim order dated 21.11.2023 and has duly complied with the conditions incorporated therein by extending full cooperation during the course of investigation. It is also brought on record that the entire proceedings arising out of the aforesaid FIR have been stayed by the Coordinate Bench of this Court in C-528 Application No. 147 of 2026 and the said order has been made absolute. No material has been placed before this Court to indicate that the applicant has either misused the liberty granted to him or failed to cooperate with the investigating agency. 7. Having regard to the facts and circumstances of the case, the order passed by the Coordinate Bench in the proceedings under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the conduct of the applicant during the period of interim protection, and without expressing any opinion on the merits of the case, this Court is of the considered opinion that the applicant has made out a case for confirmation of the interim anticipatory bail granted vide order dated 21.11.2023. 8. Consequently, the interim anticipatory bail granted to the applicant vide order dated 21.11.2023 is hereby confirmed and made absolute. Accordingly, the present Anticipatory Bail Application stands allowed.
