The petitioner has filed the present writ petition seeking a writ of mandamus commanding the respondents to consider the case of petitioner and to issue an appointment letter for the post of Assistant Teacher (Primary) against the post reserved for the OBC/ dependent of Uttarakhand Rajya Andolankari category.

The petitioner submits that pursuant to the advertisement issued by the respondent no.3/District Education Officer (Basic), Pauri Garhwal, Uttarkhand, in the year 2025, for supplying the vacancies of the Assistant Teacher (Primary) school, petitioner submitted his application. The petitioner was provisionally found selected in the said selection process and he was called upon in the document verification held on 12.01.2026. After participating in the document verification, other persons have been issued the appointment letter while the petitioner has not been issued any appointment letter so far. Even no written communication has been issued

2026:UHC:6797 2 in favour of the petitioner about his non-selection. However, on the date of document verification an exception was taken by the Scrutiny Committee about the CTET mark sheet dated 31.07.2024, wherein the category of the petitioner was mentioned as general not OBC.

Learned counsel for the petitioner submits that petitioner has filed a representation to the respondent no.3 on 11.02.2026, which is annexed as Annexure No.6 to the writ petition, wherein, petitioner prayed for an appointment letter to be issued to him.

Learned counsel for the petitioner submits that if a direction is issued to the respondent no.3 to decide the representation of the petitioner dated 11.02.2026 (Annexure No.6 to the writ petition) within a stipulated period, the ends of justice would be met.

Learned counsel for the State has no objection if such a direction be issued to respondent no.3-District Education Officer (Basic), Pauri Garhwal, Uttarkhand to decide the petitioner’s representation dated 11.02.2026 Annexure No.6 to the writ petition within a stipulated period.

Accordingly, the writ petition is disposed of finally. Respondent no.3-District Education Officer (Basic), Pauri Garhwal, Uttarkhand is directed to decide the petitioner’s representation dated 11.02.2026 (Annexure No.6 to the writ petition), within a period of four weeks from today, strictly in accordance with law, keeping in view the fact that the petitioner has secured more marks then the minimum marks required for an
