This is an application u/s 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 praying for granting pre-arrest bail to the accused/applicant in connection with Bakalia P.S. Case No. 12/2026 u/s 61(2)/126(2)/103 of the BNS. 3. An FIR was lodged on 18.04.2026 by the informant, namely, Smti. Sika Engtipi alleging inter alia that on 14.04.2026, in the evening around 3 PM, one Durgeswar Terang, Binod Terang, sons of Noga Terang of village Danghap Chingrai Terang Gaon, P.O. & P.S.- Dokmoka came to the house of the informant in search of her husband, Kamsing Ronghang and when they were told that he was not at home and had gone to see the Jhum Cultivation, they went in search of him; when the husband of the informant was returning home from the paddy field at around 5 PM, the accused/persons met her husband and assaulted him with a stick on his head and kicked him and thereby seriously injured him. That, thereafter, the accused/persons returned to the house of the informant and told her that they have assaulted and thrown her husband. That on receipt of such information, the informant along with others went in search of the husband of the informant and found him in injured condition and he was taken to Diphu Medical College Hospital, however, he died on 15.04.2026. On receipt of the FIR, the police registered Bakalia P.S. Case No. 12/2026. 4. The learned counsel appearing for the accused/applicant submits that the accused/applicant is the sister of the accused/persons and she did accompany the accused/persons to the house of the informant. But, when they were told that the informant’s husband was not at home, she returned. However, her brothers remained there both of them indulged in some kind of fight with the victim person. He submits that there is no allegation against the accused/applicant in the FIR. Page No.# 3/3 5. The Case Diary in the instant case has been produced. 6. Mr. B Sharma, the learned APP on the other hand submits that there are sufficient incriminating materials against the accused/applicant and her involvement has been prima facie found in the offence as alleged in the FIR. 7. After hearing the counsel appearing for the respective parties and on perusal of the case record, this Court is of the opinion that at this stage the accused/applicant may be granted the privilege of anticipatory bail. 8. Accordingly, it is directed that in the event of arrest of the accused/applicant, namely, Smti. Mina Terangpi in connection with Bakalia P.S. Case No. 12/2026, she shall be released on furnishing of a bail bond of Rs. 20,000/- (Twenty thousand) only with a surety of like nature to the satisfaction of the learned Arresting Authority under the conditions that the accused/applicant shall appear before the Investigating Officer within a period of 10 (ten) days from passing of this order and fully cooperate in the investigation by making herself available as and when called by the Investigating Officer. 9.
