JUSTICE JAYANT BANERJI) The aforesaid appeal is filed by the wife seeking to challenge the impugned judgment and decree dated 07.11.2022 passed in M.C.No.277/2020 by the Principal Judge, Family Court, Shivamogga, whereby the petition filed by her under Section 13(1)(ia) and (ib) and Sections 25 and 27 of the Hindu Marriage Act, 19551 was dismissed. 2. It appears that the matter was referred to the Karnataka Mediation Centre for mediation between the parties and a settlement dated 13.03.2026 has been reported. There is 1 hereinafter referred as 'the H.M. Act' - 3 - HC-KAR NC: 2026:KHC:20771-DB MFA No. 2252 of 2023 a memorandum of settlement submitted which is signed by the parties and countersigned by their respective advocates. 3. The terms of the settlement reflects that they have no children; they have no claims against each other including maintenance/alimony, be it in past, present or future and have no claims over their movable/immovable properties against each other, either existing or to be acquired in future; there are no articles to be exchanged between them and no claims against each other; they undertake to withdraw all allegations being made against each other. 4. An application under Section 13B of the H.M. Act, is moved by the counsel for the parties in the presence of the parties, which application is signed by both the parties and countersigned by their respective advocates. They seek dissolution of marriage between the parties that they solemnized on 01.09.2013 at Lagan Kalyana Mandira at Shivamogga. Reference has also been made to the settlement arrived at between the parties before the Karnataka Mediation Center. The aforesaid application under Section 13B of the H.M. Act is supported by separate affidavits of the parties endorsing - 4 - HC-KAR NC: 2026:KHC:20771-DB MFA No. 2252 of 2023 the contents of the application under Section 13B of the H.M. Act. It also reflects that they have consented to grant of divorce by mutual consent voluntarily without any force or undue influence and out of their own free will. 5. It is noted that the parties are living separately since 2015 as is admitted by the husband in his written statement filed before the trial Court. No useful purpose will be served in keeping the matter pending. 6. The application under Section 13B of H.M. Act is therefore allowed. A decree of divorce shall issue.
