Bora, learned Additional Public Prosecutor appearing for the State of Assam and Mr. S. Nawaz, learned Amicus Curiae for respondent No.2. 2. This is an application under Section 483 of the BNSS, 2023 whereby the petitioner, namely, Nazrul Islam Mazumdar has prayed for releasing him on bail after he was arrested in connection with Special (POCSO) Case No. 123/2025 registered under Sections 107/308(2)/64(1) of BNS, 2023 read with Section 6/14/15 of POCSO Act pending before the learned Additional Sessions Judge (POCSO), Cachar, Silchar corresponding to Silchar P.S. Case No. 982/2025. 3. The allegations as reflected in the FIR is that the petitioner is acting as a middleman between the victim, who was a minor at the time of initial occurrence and the former boyfriend of the victim had deceitfully obtained nude photographs of the victim. Thereafter, the petitioner used the said photographs to blackmail the victim into having sexual intercourse with him on several occasions which continued up to September, 2025. When the matter was discovered subsequently, the FIR was lodged soon after. 4. The investigation of the case is complete and the charges have also been framed and the case is pending for trial. 5. Learned counsel for the petitioner submits that considering the length of detention of about 254 days of the petitioner, the prayer for bail may be considered, particularly, considering the fact that the incident relates to the year,
2022. 6. Ms. S. H. Bora, learned Additional Public Prosecutor has vehemently objected to the prayer for bail. Page No.# 3/3
7. TCR as called for has been received, which has been perused.
The victim in her statement before the Magistrate has clearly implicated the accused person and considering the heinous nature of the offence involving the blackmailing of a minor girl into committing sexual intercourse on multiple occasions, the prayer for bail is rejected at this stage. 8.
