Learned counsel for petitioner submits that the petitioner accused is in custody since his arrest on 09.07.2025 and still trial has not progressed well. He further submitted that other accused were granted bail by this Hon'ble Court and the bail application of present petitioner was dismissed only on the ground that there were criminal antecedents against the petitioner. He further submitted that most of the cases against the petitioner were in nature of petty offence and remaining cases are under the Arms Act. 4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are grave and serious in nature. 5. Heard learned counsel for the petitioner-accused and learned Public Prosecutor. Perused the material placed on record by both the parties. 6. While considering first bail application on 13.08.2025, we have dismissed the bail application primarily on the ground that not only the allegations are serious in nature but there are criminal antecedents against the petitioner. 7. We have already granted bail to one of the accused Rohitash involved in the incident. The second bail application of present petitioner was dismissed on 13.11.2025 and at the time of dismissal of application we have observed as under: "On basis of report against unknown three persons who committed robbery with Soyab Khan by snatching his beg containing ₹2.50 Lac, a report is registered. During investigation accused Mohammad Kaif and Rohitash were [2026:RJ-JP:26645] (3 of 4) [CRLMB-5293/2026] arrested on 07.07.2025 whereas Wasim Akram @ Wasim Khan and Charan Singh were arrested on 09.07.2025. Thereafter, test identification parade was conducted by Tehsildar, Alwar. During investigation, role and involvement of these persons were found along with accused Ramveer who was arrested on 05.07.2025 and his test identification parade was conducted. The police has found that offence under Section 310(2) of BNS is made out. The police has filed charge sheet against Charan Singh, Vasim Akram, Mohammad Kaif, Rohitash and Ramveer. This Court has granted bail to accused Rohitash on 13.08.2025. The criminal antecedent submitted by police indicates that 10 criminal cases were registered against the present petitioner who was arrested by the police on 09.07.2025 and after test identification period, a charge sheet has been filed. The petitioner is a habitual criminal and criminal antecedents indicate his regular involvement in criminal cases." 8. The list of cases registered against the petitioner clearly indicate that two cases were relating to Arms Act whereas six cases were relating offence under Section 379 IPC and the similar kind of offence, one under Sections 365 and 395 of IPC. The Co- ordinate Bench has already granted bail to Mohammad Kaif on 16.01.2026. The perusal of charge-sheet indicate that there are nine witnesses and still the trial has not concluded. The petitioner is in custody for almost one year. 9. Upon hearing the arguments and perusing the record, we have found that the applicant-accused is no more required in the investigation and he is in custody for quite some time. The further proceedings will take its own time, therefore, looking to entirety of facts and circumstances of the case and without expressing any opinion on merits of the case, the Court deems it appropriate to grant bail to the applicant-accused. [2026:RJ-JP:26645] (4 of 4) [CRLMB-5293/2026] 10.
