By way of filing the instant criminal misc. application, a prayer has been made to recall the order dated 13.03.2026 passed by this Court while deciding S.B. Criminal Misc. (Petition) No.653/2016. 2. Learned counsel for accused-petitioners submits that when the aforesaid petition was listed before this Court on 13.03.2026, the matter could not be marked in the cause list and because of (2 of 2) [CRLMA-268/2026] the said bona fide mistake, he could not appear and argue the matter and absence of the counsel, the case was dismissed in default. Counsel submits that important question of law and facts are involved in the petition, which are required to be adjudicated on merits by this Court, hence, the aforesaid order be recalled. 3. Heard and considered the submissions made at the Bar. 4. Considering the arguments put forward by learned counsel for the petitioner, the instant misc. application stands allowed for the reasons stated therein.
