SANJEEV PRAKASH SHARMA Order 03/07/2026 1. Keeping in view the law laid down in the case of M/s Devender Singh Contractor vs. Union of India: D.B. Civil Reference No.1/2024, the provision laid down in the general Clauses of railway contracts have been treated as an arbitration clause. 2. Notices have been served on the respondents relating to the disputes and claims arising out of an agreement entered between the parties. 3. Accordingly, this Court deems it appropriate to appoint Arbitrator Ms. Rita Tejpal, Retired District Judge, [2026:RJ-JP:24907] (2 of 2) [ARBAP-112/2023] R/o House No.1231, Sector 37, Arun Vihar, Gautam Buddha Nagar, Noida (U.P.), to act as the Sole Arbitrator and to decide all issues without prejudice to the rights and contentions raised in the present application. The arbitration fees shall be determined in accordance with the Fourth Schedule of the Act of 1996, as amended. The fee of the Arbitrator will be equally borne by both the parties. 4.
