By way of this petition, the petitioners have prayed for following reliefs:- “10.1 It is therefore prayed that, this Hon'ble Court may kindly pleased to direct the respondent no. 2. Collector Balodabazar-Bhatapara, CG to decide the stay application u/s 8 of the 1995 Rules & application u/s 21(4) of the 1993 Act pending before him in Case No. 202603210100030/A-89/2025-26, within stipulated time period. 10.2 To direct the respondent no. 1 to 4, not to take any 4 steps regarding election to the post of Sarpanch in Village Daawanbod, Tahsil Simga, District Balodabazar- Bhatapara, CG with respect to no-confidence motion dated 23.03.2026 till the stay application is decided by the respondent no. 2. 10.3 Any other relief/reliefs, which this Hon'ble Court may think fit and proper in the facts and circumstances of the case, may also please be granted to the petitioner.” 2. Brief facts of the case, is that, the petitioner has filed the present writ petition seeking a direction to the Collector, Balodabazar- Bhatapara, to decide the stay application filed under Section 8 of the Chhattisgarh Panchayat (Appeal and Revision) Rules, 1995 on the next date of hearing, and also to decide the application filed under Section 21(4) of the Chhattisgarh Panchayati Raj Adhiniyam, 1993 within a stipulated time period, both of which have been preferred by the petitioner challenging the no- confidence motion dated 23.03.2026; that it is submitted that on 11.03.2026, the Up-Sarpanch along with nine other Panchs of Village Daawanbod, Tahsil Simga, District Balodabazar-Bhatapara (C.G.) moved a no-confidence motion against the petitioner, who is the elected Sarpanch, before the SDO, Simga, alleging various grounds including illegal encroachment, criminal antecedents, and misuse of position; that the SDO, Simga registered the proceedings as Revenue Case No. 202603211000054/A-89/6 and, vide order dated 18.03.2026, appointed the Tahsildar, Simga 5 as the Presiding Officer, fixing 23.03.2026 as the date of meeting, on which date the no-confidence motion was passed against the petitioner; that being aggrieved by the said motion, the petitioner preferred a dispute under Section 21(4) of the Act, 1993 on 27.03.2026 before the Collector, along with an application seeking stay of the operation of the no-confidence resolution under Section 8 of the Rules, 1995; that the said case was registered by the Collector on 30.03.2026 as Revenue Case No. 202603210100030/A-89/2025-26 and notices were issued on 13.04.2026, calling for records and fixing 27.04.2026 as the next date; however, despite the statutory mandate requiring decision within a reasonable time, particularly within 30 days, the application under Section 21(4) as well as the stay application are still pending; that in the meantime, there is an imminent possibility of announcement of election schedule in view of the no- confidence motion having been passed, and the Up-Sarpanch is presently discharging the functions of Sarpanch; that in these circumstances, the petitioner has been constrained to approach this Hon’ble Court seeking appropriate directions for expeditious disposal of the pending applications, hence the present petition. 3. Learned counsel for the petitioner submits that the present petition has been filed with a limited prayer seeking a direction to the respondent authorities, particularly the Collector, Balodabazar- Bhatapara (C.G.), to consider and decide the petitioner’s pending stay application under Section 8 of the Chhattisgarh Panchayat 6 (Appeal and Revision) Rules, 1995, as well as the application filed under Section 21(4) of the Chhattisgarh Panchayati Raj Adhiniyam, 1993, within a reasonable and stipulated period. 4. On the other hand, learned counsel appearing for the State submits that, upon obtaining instructions from the concerned authorities, it is conveyed that in the event the petitioner files an application seeking urgent hearing, the same shall be taken up and considered forthwith for hearing, particularly with regard to the application filed under Section 8 of the 1995 Rules. 5. Considering the fact and circumstances of the case and further considering the submission made by the State that the application shall be considered upon filing of an application for urgent hearing, it is directed that the petitioner shall prefer an appropriate application seeking urgent hearing before the concerned Collector, and upon such application being filed, the concerned Collector shall consider and decide the same expeditiously, along with the petitioner’s application under Section 8 of the 1995 Rules, in accordance with law. 6.
