Mr. Bilal Ahmed, learned counsel for the applicant. Mr. Prabhat Kandpal, learned A.G.A for the State of Uttarakhand. 2. On the last date, the State was directed to seek instructions in the matter. 3. Today, on the basis of the instructions so received, learned State Counsel submits that a non-bailable warrant (NBW) has been issued against the applicant, as the applicant has not been participating in the trial. It is further submitted that 08.09.2026 is the next date fixed before the learned Trial Court. 4. Learned counsel for the applicant submits that the applicant shall participate in the trial and shall appear before the learned Trial Court on the next date fixed. 5. In view of the submission made by learned counsel for the applicant, it is directed that the applicant shall appear before the learned Trial Court on 08.09.2026. Till then, i.e. 08.09.2026, the NBW issued against the applicant shall not be enforced. It is made clear that in the event the applicant fails to appear before the learned Trial Court on the date fixed, the protection granted by this order shall stand automatically vacated. 6. Learned counsel for the applicant further submits that the applicant is suffering from kidney disease and is undergoing dialysis. He seeks liberty to UKHC010202912025 2026:UHC:7414 move an appropriate bail application before the learned Trial Court and prays that the same may be considered expeditiously. 7. In view of the aforesaid submission, it is observed that, in case the applicant moves an appropriate bail application before the learned Trial Court, the same shall be considered and decided as expeditiously as possible, in accordance with law. 8. With the aforesaid directions, the present Second Anticipatory Bail Application stands disposed of.
