[2026:RJ-JP:26281] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 15314/2025 URN: CRLMB / 29487U / 2025 Lal Singh S/o Shree Het Singh, Aged About 50 Years, R/o Gram Bartai Police Station Kumher District Deeg. ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Amit Singh Shekhawat For Respondent(s) : Mr. Vivek Sharma, Addl. G.A. Mr. Rahul Sinsinwar HON'BLE MR. JUSTICE BIPIN GUPTA Judgment / Order 13/07/2026 1. The present criminal miscellaneous bail application has been preferred by the accused-petitioner under Section 482 of the BNSS, 2023, apprehending his arrest in connection with FIR No. 678/2024 dated 28.09.2024, registered at Police Station-Kumher, District-Deeg, for the offences punishable under Sections 189(2), 115(2), 126(2), 352, 117(2), 118(1), 118(2), 3(5) of the BNS. 2. Learned counsel for the petitioner submits that the FIR was initially registered for offences which were bailable in nature. He further submits that subsequently, the provisions of Sections 118(1) and 118(2) of the applicable law were invoked on account of the amputation injury being reflected in the injury report. 3. Learned counsel for the petitioner further submits that the amputation of the little finger was not caused during the present incident and that the victim had already suffered such injury in the year 2004, which is evident from the injury report of the victim. [2026:RJ-JP:26281] (2 of 3) [CRLMB-15314/2025] He further submits that, as per the opinion of the Doctor, the injuries attributed to the petitioner are simple in nature. 4. Learned counsel for the petitioner submits that the petitioner has already joined the investigation and has been protected by way of interim protection since 08.01.2026. Therefore, it is prayed that the bail application may be allowed. 5. Learned Additional Government Advocate has strongly opposed the bail application. 6. Learned counsel appearing for the complainant submits that the injury has been caused by sharp weapon. Therefore, the benefit of anticipatory bail may not be granted. 7. Considering the overall facts and circumstances of the case, without expressing any opinion on the merits and demerits of the case, and taking into consideration the submissions made by learned counsel for the petitioner that the FIR was initially registered for bailable offences, the subsequent invocation of Sections 118(1) and 118(2) of the BNS was on account of the amputation injury reflected in the injury report, and the contention that the amputation of the little finger was not attributable to the present incident and was an old injury sustained in the year 2004, coupled with the fact that the petitioner has already joined the investigation and has been protected by way of interim protection since 08.01.2026, this Court is of the considered view that no fruitful purpose would be served by subjecting the petitioner to custodial interrogation. Accordingly, this Court deems it just and proper to enlarge the petitioner on anticipatory bail. [2026:RJ-JP:26281] (3 of 3) [CRLMB-15314/2025] 8. Accordingly, the present anticipatory bail application filed by the accused-petitioner under Section 482 of BNSS, 2023, is allowed.
