2. Director General of Police, Cuttack
3. Superintendent of Police, Jajpur

….
Opposite Parties Mr. Ashok Kumar Apat, Additional Government Advocate
CORAM:
THE HON’BLE MISS JUSTICE SAVITRI RATHO
Order No.
ORDER 18.03.2026
01.
(Through hybrid mode)
1. This CRLMP has been filed by the Petitioner for a direction to the Opposite Party Nos.2 to 4 to execute the orders of Non- Bailable Warrant of arrest against the Opposite Party No.5 issued by the learned JMFC-III (Cog. Taking), Cuttack in 1CC Case No.22 of 20218 (wrongly typed in place of ‘2018’) and to expedite the trial. Copy of the entire order-sheets in 1CC Case No.22 of 2018 have been annexed to the application as Annexure-2.
2. Perusal of the order sheet reveals that the application of the accused-Opposite Party No.5 under Section 205 of the Cr.P.C. has
been allowed on 04.01.2019 but thereafter on subsequent dates, as the accused defaulted in appearance, bailable warrant has been issued against him on 20.06.2025. Thereafter, reminders have been issued for execution of the bailable warrant. Ultimately on 11.11.2025 non-bailable warrant has been issued against him and case posted on 09.01.2026 for his production. Although this CRLMP has been filed on 24.02.2026, details of the order passed on 09.01.2026 have not been mentioned in the CRLMP nor has copy of the order been filed.
3. Be that as it may, since non-bailable warrant has been issued against the Opposite Party No.5, it is the duty of the concerned IIC to execute the same. Hence, it is expected that the Opposite Party No.4, the Inspector-In-Charge of Panikoili Police Station will take expeditious steps in accordance with law for execution of the non-bailable warrant issued by the learned JMFC- III (Cog. Taking), Cuttack in 1CC Case No.22 of 2018, if there is no legal impediment.
4. With this observation, the CRLMP is disposed of.
