Heard Mr. Kaushalendra Prasad, learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is an accused in connection with S.T. No.234 of 2025 arising out of Majhgaon P.S. Case No. 26 of 2024 corresponding to G. R. No. 211 of 2025 pending in the Court of learned Additional Sessions Judge II-cum-Special Judge, POCSO Act Cases, West Singhbhum at Chaibasa.
The prayer for bail of the petitioner was rejected earlier in B.A. No.7519 of
2025.
It has been submitted by the learned counsel on behalf of the petitioner that out of 23 charge sheet witnesses, only 05 witnesses have been examined including the informant, but none have alleged against the petitioner. Learned counsel submits that the petitioner is in custody since 03.04.2025.
Learned A.P.P. for the State has opposed the prayer for bail of the petitioner and has submitted that on the confession of the petitioner, murder weapon was recovered.
It appears that the wife of the informant was murdered by some unknown persons. Subsequently, on the confession of one Gangaram Budiduli, the petitioner had been named and the petitioner had also subsequently confessed. On the confession of the petitioner, the murder weapon was recovered.
Regard being had to the aforesaid facts and the fact that the trial is progressing, I am not inclined to reconsider the bail to the petitioner and the same is hereby rejected once again.
