The petitioner has assailed the letter of Block Development Officer, Lalgola, Murshidabad issued on February 16, 2026 which records that no removal of Pradhan can be effected before completion of three years from the date of assumption of office as per bill no. 9 of 2026 dated March 07, 2026, Kolkata Gazette Notification. It is a fact that the said bill has not been assented and therefore cannot be acted upon. Therefore, the letter issued by the prescribed authority is devoid of any legal sanction and is set aside. However, learned counsel for the respondent points out certain defects in the requisition notice and submits that the said notice has not been issued in terms of Section 12(2) of the West Bengal Panchayat Act, 1973 (in short, “the Act of 1973”). Learned counsel for the petitioner seeks liberty to move a fresh no confidence motion before the prescribed
authority in terms of Section 12(2) of the Act of 1973. Such liberty is granted. On receipt of such requisition, the prescribed authority shall act strictly in terms of Section 12 of the Act of 1973. The writ petition is accordingly disposed of. There shall, however, be no order as to costs.
