JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question the proceedings in C.C.No.48383/2025 registered for offences punishable under Sections 85, 351(2), 352 of the Bharatiya Nyaya Sanhita and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Heard Sri. Sachin Kumar B.M., learned counsel appearing for the petitioner, Sri. K Nageshwarappa, learned counsel appearing for respondent No.1, Sri. G.H.Channa Gangaiah, learned counsel appearing for respondent No.2 and have perused the material on record. 3. The parties to the lis were also before the Family Court in M.C.No.2849/2025 and have settled the dispute amongst themselves before the Family Court by terms of settlement and also have filed the compounding application along with an affidavit. The compounding application reads as follows: - 4 - HC-KAR NC: 2026:KHC:8391 CRL.P No. 1096 of 2026 "APPLICATION UNDER SECTION 528 READ WITH SECTION 320(2) OF CRIMINAL PROCEDURE CODE "The Petitioner and Respondent No.2 respectfully submit as follows: 1. It is submitted that, in the above criminal petition, the petitioner is seeking for quashing the entire proceedings pending against him in C.C.No.48383/2025 (Crime No.51/2025 of Sanjay Nagar Police Station) pending on the file of 32nd A.C.J.M Court at Bangalore, for the offences under section 85, 352, 351(2), 3 of BNS Act and section 3 and 4 of DP Act. 2. It is submitted in the above case the respondent no.2/complainant filed the case against the petitioner before the respondent police which is registered in Crime No.51/2025 of Sanjay Nagar Women's Police Station for the offences punishable under section 85,352, 351(2), 3 of BNS Act and section 3 and 4 of DP Act and after the investigation filed the charge sheet for the offence under section 85,352, 351(2), 3 of BNS Act and section 3 and 4 of DP Act. The respondent no.2 herein is the complainant, aggrieved person and competent to compound the offences alleged in the complaint. It is submitted that the dispute between the parties are settled amicably and the respondent No.2 has no objection to quash the case against the Petitioner. 3. It is submitted that, the dispute between the parties settled amicably outside the court & the Respondent No.2/complainant does not wish to proceed in the case and respondent no.2 has no objection to quash the case - 5 - HC-KAR NC: 2026:KHC:8391 CRL.P No. 1096 of 2026 against petitioner herein and ready to compromise the matter with the permission of the court. In view of the above settlement, the respondent no.2 has no objection to quash the above criminal proceedings against the petitioner for the aforesaid offences. In view of the facts and circumstances of the case, it is just and proper to permit the parties to compound the offence alleged against the Petitioner and quash the entire proceedings in C.C.No.48383/2025 (Crime No. 51/2025 of Sanjay Nagar Women's Police Station) pending on the file of 32nd A.C.J.M Court at Bangalore, for the offences under section 85, 352, 351(2), 3 of BNS Act and section 3 and 4 of DP Act. Otherwise, the Petitioner will be put to irreparable injury and hardship. 4. It is submitted that the petitioner and the respondent No.2 has filed a petition under section 13(1) (i-a) and 13(i-b) of Hindu Mariage Act, before the IV Addl Principal and Family Judge, Family Court at Bengaluru and petitioner and 2nd respondent are agree to dissolution of the marriage in MC No.2849/2025, hence both the parties entered in to an memorandum of settlement under section 89 of CPC R/w Rule 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules 2005. That the said agreement the respondent No.2 was agreed to withdraw the proceedings in CC No.48383/2025 (Crime No.51/2025 of Sanjay Nagar Women's Police Station). WHEREFORE, it is prayed that this Hon'ble Court be pleased to permit the parties to compound the offences against the Petitioner and quash the entire proceedings against the petitioner in CC.No.48383/2025 - 6 - HC-KAR NC: 2026:KHC:8391 CRL.P No. 1096 of 2026 (Crime No.51/2022 of Sanjay Nagar Women's Police Station) pending on the file of 32nd A.C.J.M Court at Bangalore, for the offences under section 85, 352, 351(2), 3 of BNS Act and section 3 and 4 of DP Act., in the interest of justice." 4. Therefore, in light of the settlement arrived at between the parties quoted supra and offences not being against the State, I deem it appropriate to terminate the proceedings pending against the petitioner in the subject petition. 5. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii.
