JUSTICE SUSMITA PHUKAN KHAUND ORDER Date : 13.07.2026 Heard learned Counsel Mr. R.Sarma for the petitioner Debajani Kalita Deka @ Devajani Deka who has filed this application under Section 528 of the BNSS,2023 with prayer for setting aside the impugned order dated 28.02.2024 passed in connection with PRC Case No.244/2018 by the learned Additional Page No.# 2/2 CJM, Kamrup (Metro). 2. It is submitted by the learned counsel for the petitioner that the case is fixed for appearance and report. Vide order dated 28.02.2024, P & A was issued against the petitioner and the next date for hearing was fixed on 20.07.2024. It is submitted that this case is still at the stage of appearance and the petitioner is willing to co-operate with the proceedings of PRC case No. 244 /2018. 3. Learned Additional Public Prosecutor Mr. D.P.Goswami for the State respondent is present. 4. I have taken a pragmatic view. Instead of keeping the case pending further, the NBWA and P & A issued against the petitioner is kept in abeyance for 15 days and within 15 days, the petitioner is directed to appear before the learned trial court and co-operate with the trial. 5.
