Learned senior advocate appearing for the petitioner submits that the petitioner is similarly situated as the other accused person who has been granted bail and associated with the police department. Petitioner is an Assistant Sub-Inspector of Police and is in custody for more than 11 months. Learned advocate for the State opposes the prayer for bail and submits that there are materials to support that the petitioner was extorting money from the drug dealers. Having regard to the fact that there are 24 witnesses in support of the prosecution case and some time will be required to 2 take the trial to its logical conclusion, I am of the view that the petitioner being not a flight risk, he may be granted bail. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Md. Safikul Islam @ Md. Safiqul Islam shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand) each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act- Cum-learned Additional District Judge, 4th Court, Malda. If on bail, the petitioner shall be physically present on each and every date fixed by the learned special court and shall not leave the jurisdiction of the district of Malda without prior permission of learned special court. Accordingly, CRM(NDPS) 709 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
