Simdega, Jharkhand. … Respondent(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Akhouri Sankalp, Advocate For the State : Mr. Anshuman Kumar, AC to SC (L&C)-II …...... 02/21.01.2026: By way of filing this writ petition, the petitioner has sought for the following reliefs:- For direction to the respondents to provide the benefits of 1st and 2nd ACP to the petitioner from the date of 13.07.2000 and 13.07.2012 respectively with entire arrear monetary benefits with interest, as he has been appointed in the service on 13.07.1988 as a Forest Guard. 2. The petitioner was appointed as a Forest Guard in the Forest and Environment Department on 13.07.1988. He superannuated from service on 31.03.2017 from the office of the Divisional Forest Officer, Simdega. After retirement, he repeatedly requested by filing the representation to the authorities to grant him the 1st and 2nd ACP benefits, but no action was taken. His representation to the Divisional Forest Officer, Simdega is still pending. 3. Learned counsel for the petitioner submits that petitioner’s case is fully covered by a previous judgment of the Jharkhand High Court in W.P. (S) No. 6081/2014 (Krishna Kumar Oraon vs State of Jharkhand & Others), where similarly placed employees were granted the 2nd ACP in the pay scale of Rs. 6500–10500. Therefore, the petitioner is entitled to the same benefit and seeks fair relief from the Court. 4. Learned counsel appearing on behalf of the respondents submits that if the petitioner files a fresh representation, before the Divisional Forest Officer, Forest Division, Simdega-respondent No.4, his case will be considered and an appropriate order will be passed as per law. 1. 5. Considering the submission of the parties, I direct the petitioner to file a fresh representation within four weeks before the Divisional Forest Officer, Forest Division, Simdega- respondent No.4. On receipt of such representation for grant of 1st and 2nd ACP to the petitioner, his case will be considered within six weeks thereafter. 6. If it is found that the petitioner is entitled for any benefit, the same should be extended within four weeks thereafter. 7. If any part of the claim of the petitioner is rejected, the reasons should also be communicated to the petitioner within the aforesaid period. 8. It should be noted that while considering the case of the petitioner for grant of 1st and 2nd ACP, the respondents will not seek educational qualification required for the purposes of promotion, which is not necessary for the grant of in-situ promotion, i.e., only for extending the monetary benefits. 9.
