The present application has been preferred by the accused- petitioner under Section 482 of the BNSS, 2023, apprehending his arrest in connection with FIR No. 587/2025 dated 09.09.2025, registered at Police Station Mathura Gate, District Bharatpur, for the offences punishable under Sections 74, 87, 64(1)/62, 352, 351(2), 351(3), and 61(2) of the BNS, 2023. The Coordinate Bench of this Court has granted interim protection to the petitioner vide order dated 07.01.2026. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present FIR. It is further submitted that the petitioner has already joined the investigation and, therefore, he may be enlarged on the anticipatory bail. [2026:RJ-JP:26326] (2 of 2) [CRLMB-15704/2025] 3. Per contra, learned Public Prosecutor has opposed the present bail application. 4. Learned counsel appearing on behalf of the complainant/victim submits that the petitioner, while taking undue advantage of the interim protection granted by this Court, has committed a similar offence of rape against a minor, for which another FIR has already been registered against the present petitioner on 05.05.2026, being FIR No. 279/2026, at Police Station Mathura Gate, District Bharatpur. Therefore, learned counsel for the complainant/victim has opposed the present bail application. 5. Without expressing any opinion on the merits of the case, and considering the fact that the petitioner, while availing the benefit of interim protection granted by this Court on 07.01.2026, has allegedly been found involved in a similar offence, thereafter, therefore this Court is not inclined to grant the benefit of anticipatory bail to the petitioner. 6.
