The petitioner is apprehending his arrest in connection with Mirzachouki P.S. Case No.31 of 2025, for the alleged offences registered under Sections 303(2) and 317(2) of Bharatiya Nyaya Sanhita, 2023, Rule 4 and 54 of Jharkhand Minor Mineral Concession Rules, 2004 and Rule 7, 9 and 13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2017 pending in the Court of learned S.D.J.M., Sahibganj. 3. Learned counsel appearing for the petitioner submits that the petitioner is the owner of poclain machine and the driver of said poclain machine has been granted anticipatory bail by this Court in ABA No.472 of 2026. He further submits that the poclain was only parked and false allegations are made of utilizing the said poclain in illegal mining. He then submits that the petitioner has got no criminal antecedent as disclosed in 2026:JHHC:2718 --2-- A.B.A. No. 537 of 2026 paragraph No.28 of the petition. 4. Learned counsel appearing for the State opposes the prayer and submits that the petitioner happened to be the owner and allegations are made of utilizing the said poclain machine in illegal mining. 5. Considering that the petitioner is the owner of said poclain machine and the driver of said poclain machine has been granted anticipatory bail by this Court in the aforesaid ABA and the petitioner has got no criminal antecedent as disclosed in paragraph No.28 of the petition and no seizure of any mine articles are there, I am inclined to provide anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Sahibganj in connection with Mirzachouki P.S.
