Learned advocate appearing for the petitioner submits that the petitioner is in custody for about one year eight months and only 7 out of 31 witnesses cited by the prosecution till date have been examined. Learned advocate for the de-facto complainant is present and opposes the prayer for bail. Learned advocate for the State points out that on the last occasion the witness was produced through video-conference when the defence refused to examine the witness. It has been additionally submitted that 15 witnesses have already been examined. One of 2 the accused was granted bail during the vacation which has been stayed by the Hon’ble Supreme Court. Trial is progressing in a smooth manner. At this stage release of the petitioner will jeopardize the further progress of the case. Having regard to the complicity of the present petitioner, at this stage, I am not inclined to release the petitioner on bail. Accordingly, CRM (M) 737 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
