The petitioner has filed this writ petition praying for the following reliefs: 10.1 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to release the interest part with final payment authorization letter of General Provident Fund (GPF) account of petitioner of Rs. 3,97,565/- as well as non-payment of Rs. 1,53,340/- of such GPF account of petitioner, from the June 2024, within prescribed time, in the interest of justice. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to consider and decide the petitioner’s representations (Annexure P/4), regarding payment of interest on delayed payment of petitioner’s GPF account from the retirement till realization of payment in compliance of authorization letter, within stipulated time, in the 3 interest of justice. 10.3 That, any other relief which the Hon’ble Court may deem fit and proper also be granted to the petitioner, in the interest of justice. 2. Counsel for the petitioner submits that petitioner while working on the post of Headmaster, Primary School has retired upon attaining the age of superannuation on 30.06.2024. After retirement some retiral dues have been paid, however the entire amount towards the G.P.F. in the account of the petitioner has not been disbursed. It is the contention of the counsel for the petitioner that on the date of retirement, a sum of Rs. 3,97,565/- was deposited in the account of the petitioner. The petitioner was entitled for a sum of Rs. 3,97,565/- however, out of the aforementioned amount, a sum of Rs. 1,53,340/- has not been paid and is still pending with respondent no. 6 therefore a direction be issued to respondent no. 6 to disburse the sum of Rs. 1,53,340/- in favour of the petitioner at the earliest. 3. Counsel for the respondent no. 6 would oppose the submission of the counsel for the petitioner and would submit that sum of (1) Rs. 98,560, (2) Rs. 75264/-, (3) Rs. 70398/- respectively of GPF with interest was disbursed to petitioner. Now, there is no balance in the GPF account of petitioner to be paid. 4. Counsel for the State submits that she may be granted time to seek instructions. 5. I have heard learned counsel for the parties. 4 6. The dispute which is raised by the counsel for the petitioner is with regard to the non-payment of the entire amount of GPF account. The GPF account is maintained by the respondent no. 6 of the government servants. The GPF account maintained by respondent no. 6 is based on the information supplied by the officer of the State government. Perusal of the documents at Page 14 enclosed alongwith the writ petition would show that the Block Education Officer, Arang wrote a letter to respondent no. 6 about some discrepancy in payment of the amount and the interest in the amount of the General Provident Fund of the petitioner which was replied by the Officer of respondent no. 6 on 30.07.2025. 7. In the aforementioned facts of the case, inspite of keeping this writ petition pending seeking reply from the respondents, I am of the view that respondent no. 3,4 and 6 would be proper authority to decide the grievance at first instance upon verifying the record of the GPF account maintained by respondent no. 4 and 6. 8. Accordingly, writ petition at this stage is disposed off with the direction to respondent no. 4 to send the record of GPF account of petitioner to respondent no. 6. In turn respondent no. 6 will fix the date of meeting off petitioner, respondent no. 4 and 6 in the office of respondent no. 6 and to pass appropriate order on the claim of petitioner after verifying the records. 9. Respondent no. 4 is directed to forward the copy of the GPF account of the petitioner within period of two weeks and hereafter respondent no. 6 shall complete the proceedings as observed 5 above within further period of three weeks 10.
