The petitioners are apprehending their arrest in connection with Complaint Case No.1702 of 2021, for the alleged offences registered under Sections 42 of Indian Forest Act and Section 51(1) of Wild Life Protection Act, 1972 pending in the Court of learned Chief Judicial Magistrate, Koderma. 3. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the case and false allegations are made of taking mica scrap. He further submits that the petitioners are earning their livelihood by way of doing labour work. He then submits that one of the co-accused person has already been granted anticipatory bail by Co-ordinate Bench of this 2026:JHHC:741 --2-- A.B.A. No. 60 of 2026 Court in ABA No.11482 of 2022. He then submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.21 of the petition. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there against the petitioners of doing theft of mica scrap. 5. Considering that the petitioners are said to be labourer and the petitioners have got no criminal antecedent as disclosed in paragraph No.21 of the petition and one of the co-accused person has already been granted anticipatory bail in the aforesaid ABA, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Koderma in connection with Complaint Case No.1702 of 2021, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
